PLEASE READ CAREFULLY. BY REGISTERING FOR OR USING THE TACO PALENQUE APP, WEBSITE, OR TACO P REWARDS PROGRAM, YOU AGREE TO THESE TERMS, INCLUDING THE DISPUTE RESOLUTION PROVISIONS BELOW. BY ACCEPTING THESE TERMS, YOU AGREE THAT ANY DISPUTE RELATED TO THESE TERMS, THE REWARDS PROGRAM, OR OUR PRIVACY POLICY, WILL BE RESOLVED THROUGH BINDING ARBITRATION. YOU ALSO AGREE TO WAIVE ANY RIGHT TO A CLASS ACTION OR JURY TRIAL. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OR PARTICIPATE IN THE TACO P REWARDS PROGRAM.
Welcome to Taco P Rewards (the “Program”), operated by Taco Palenque Holdings, LLC and its affiliates and subsidiaries (“Taco Palenque,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern participation in the Program and use of the Taco Palenque mobile app (the “App”) and website (the “Website”). By accessing or using the Program, App, or Website, you (“Participant,” “User,” “You,” “Individual”) agree to these Terms, and our Privacy Policy, located at https://tacopalenque.com/privacy/.
1. Program Scope
- The loyalty program is called Taco P Rewards.
- The Program rewards customer loyalty through points, incentives, and personalized offers.
- The Program applies to orders placed at US locations via the App or Website. Over time, the Program may expand to include in-restaurant, kiosks, drive-thru, and other channels at US locations. Orders placed through our Catering Channel do not apply to the Program. Orders placed directly through food ordering platforms (i.e., Uber Eats, DoorDash, Grubhub, etc.) are not qualifying purchases and are not eligible for Taco P Rewards points.
- The Program applies to Taco Palenque company-owned and licensed locations participating in the Program.
- The official and most current Program structure, reward levels, and promotional terms will always be those published on tacopalenque.com/rewards and within the App. Taco Palenque reserves the right to modify, correct, or update Program information at any time, without notice.
2. Eligibility and Registration
- Participation is open only to individuals 16 years of age or older.
- Users must register through the App or Website with a valid email, phone number, and other required information.
- Only one account per individual transacting in their personal capacity is allowed. Duplicate or fraudulent accounts may be terminated, and points forfeited.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current information. Failure to do so may result in suspension or termination.
3. Sign-Up Offer, Points, and Rewards
- Taco Palenque may offer sign-up incentives, bonus points, or promotional rewards to new members upon registration, verification, or qualifying actions.
- “Rewards” include eligible menu items, access to special offers, discounts, discretionary marketing promotions for Participants, and a birthday Reward.
- Members earn points on eligible purchases made through the App, Website, or other designated ordering channels. Point-earning rates and exclusions may change at any time.
- “Points” may be earned per purchase and be redeemed for discounts, Rewards, or other Program benefits as listed on tacopalenque.com/rewards. Reward points, incentives, and offers via the Program are purely promotional and convey no property right to You. Rewards points have no cash value and are not redeemable for gift certificates or gift cards.
- Members may receive birthday Rewards or special offers. Details, expiration dates, and requirements are posted on the App or Website.
- Points currently do not expire, but all offers and Rewards have expiration dates displayed in the App or Website.
- Taco Palenque reserves the right to modify or discontinue offers, redemption thresholds, or reward types at any time.
- Rewards and Points are non-transferable, and only one Reward may be redeemed per transaction unless otherwise stated.
- There may be a limited number of a particular Reward menu items available, and those Rewards will be delivered on a first-come, first-served basis. Taco Palenque reserves the right to modify, amend, or revise available Rewards. Participants may not rely on the continued availability of a particular Reward. Rewards are redeemable on individual qualifying items or a discount toward Your purchase as specified in the Reward details.
- Members registered only with a US-based phone number may earn Points but cannot redeem rewards until full registration is completed.
4. Program Evolution and Termination
- Taco Palenque reserves the right to modify, update, suspend, or terminate the Program, App, Website, or any features at any time, for any reason, without notice.
- Changes may be communicated via App, Website, email, or in-store signage.
- Existing Points and Rewards may expire immediately unless otherwise specified.
- The Program may evolve with new tiers, benefits, channels, or partner integrations.
5. Use of the App, Website, Ordering, and Customer Support
- By using the App, Website, or Program, you agree to these Terms and posted updates.
- The App and Website may be used only for lawful, personal, non-commercial purposes.
- You may not engage in fraudulent, abusive, or unlawful activity or attempt to gain unauthorized access.
- Orders placed through the App or Website constitute an offer to purchase and are subject to acceptance by Taco Palenque. If an order is not accepted, any payment collected will be promptly refunded.
- Payment is required at the time of online or in-app order placement. Refund timing may depend on your financial institution. When a refund is accepted and successfully processed, Taco Palenque may reinstate Points used on the refunded purchase.
- Prices, menu items, qualifying purchases or Rewards, and participating locations are offered “as is” and subject to availability at the time an order is placed and accepted. While prices, menu items, qualifying purchases or Rewards, and participating locations may be modified or discontinued at any time, without notice at Our discretion, once an order is accepted, the purchase price will not be increased.
- For order issues (missing items, incorrect items, etc.), contact Taco Palenque promptly through the App, Website, or Customer Service.
- Device and software compatibility cannot be guaranteed; updates may be required. We are not responsible for device and software compatibility or connectivity issues.
- Feedback or suggestions submitted to Taco Palenque may be used without obligation or compensation.
- Accounts violating these Terms or appearing fraudulent may be suspended or terminated.
6. Intellectual Property
- All trademarks, content, and software associated with the Program, App, and Website are owned by Taco Palenque or its licensors.
- You may not copy, reproduce, distribute, or modify materials without written consent.
- Unauthorized use may result in termination and legal action.
7. Data Protection and Privacy
- Taco Palenque collects and processes personal information to operate the Program and improve services.
- The Program uses third-party platforms and service providers (“Technology Service Provider”) to support the operation of the App, Website, and Taco P Rewards Program. Technology Service Providers may securely process your personal information on our behalf pursuant to data-processing agreements requiring them to follow applicable data-protection and confidentiality requirements as applicable by law.
- While Taco Palenque exercises reasonable care in selecting and contracting with Technology Service Providers, such providers operate independently. As such, Taco Palenque is not responsible for the availability, performance, or independent privacy policies or practices of any third-party provider, except to the extent as required by law.
- You may access, update, or request deletion of your personal data by contacting us as described in our Privacy Policy.
- Our digital platforms use cookies and analytics tools to enhance performance and user experience. By enrolling in the Program, you agree to our use of cookies and similar technologies.

8. Communications and Consent
- By enrolling, you explicitly consent to receiving emails, SMS, and push notifications related to your account and Program updates.
- You may opt out of marketing communications at any time, though transactional verification notices may still be sent.
9. Disclaimer, Limitation of Liability, Indemnification
- THE PROGRAM, APP, AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLED, REGARDING THE OPERATION, AVAILIBILITY, OR FUNCTIONALITY OF THE PROGRAM, WEBSITE, OR APP, INCLUDING THE CONTINUED AVAILIBILITY, VALUE, OR DURATION, OF THE PROGRAM’S POINTS, REWARDS, OR ANY OTHER GRATUITOUS BENEFITS, TO THE FULLEST EXTENT PERMITTED BY LAW.
- WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR CONDUCT OF ANY THIRD-PARTY SERVICE PROVIDERS, PARTNERS, SPONSORS, LICENSORS, OR OTHER SIMILAR PARTIES THAT MAY BE ASSOCIATED OR INVOLVED WITH OUR SERVICES. ANY PRODUCTS, SERVICES, OFFERS, OR FEATURES PROVIDED BY THESE THIRD PARTIES ARE PROVIDED BY THEM, NOT BY US, AND YOU USE THEM AT YOUR OWN RISK.
- YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS Taco Palenque, its affiliates, third party service providers, and each of their respective officers, directors, employees, and agents from and against any and all claims, demands, losses, liabilities, damages, judgments, costs, and expenses to the extent arising out of or resulting from your breach of these Terms; or your access to or use of Our services, including any programs, offers, or features made available through Our services, except to the extent caused by the gross negligence or willful misconduct of Taco Palenque or its affiliates.
- To the fullest extent permitted by law, Taco Palenque, including its Affiliates, shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from use or inability to use the Program or its services. If it is determined that We improperly denied You any Reward or benefit, your sole and exclusive remedy shall be limited to the issuance of the equivalent Reward, if available. We are not responsible for service interruptions, network outages, data loss, or issues caused by third party service providers or acts beyond our control. This program is not intended to, and shall not be construed to, mislead consumers or to create false, misleading, or deceptive practices under the Texas Deceptive Trade-Consumer Protection Act (“DTPA”).
10. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the State of Texas.
- These terms, and any dispute, claim, or controversy arising out of or relating to the Program, App, or Website, shall be resolved through binding arbitration on an individual basis in Laredo, Texas, administered by the American Arbitration Association rules then in effect. Payment of all fees related to the arbitration shall be governed by the American Arbitration Association rules.
- By enrolling in Our Program, You hereby voluntarily waive any right to a jury trial or class action participation.
- If any provision is unenforceable or unlawful, then that provision shall be severable, and all other provisions shall remain fully enforceable.
